Buyer Beware

Subbmitted by a reader 9/04/07
My husband, stepson, stepdaughter, and I went to 579 clothing store to exchange a pair of jeans that my stepdaughter purchased with her mother the previous weekend because they did not fit her. There was nothing wrong with the jeans otherwise. That day she bought these jeans, they made an exchange. The sales manager on duty and another sales associate would not allow the transaction to occur. No amount of reason would change their mind. The policy was not written on the receipt. The one sign they had stating this exchange policy was turned away from the counter. The sales manager and sales associate were argumentative, rude, insulting, and unwilling to do anything. They didn't offer an apology. They threatened us in fact with arrest and being thrown out of the mall. I am just remembering that right now, in fact. All we wanted was a simple exchange. The store was a mess. The store was not busy. It was a Sunday afternoon around 4pm. 579 is not registered with the BBB because of a dissatisfactory record with a number of unresolved customer complaints. It looks like they are in violation of MA state consumer protection laws. I am not a lawyer but from what I gather after reading the statute that the policy 579 has in place is not clear and not in plain view and that would be a violation of MA state Consumer protection law under refunds and returns. But the customer service was terrible. I stated that on our exit. One customer who came in after we were getting ready to leave, said "I'm pregnant. I don't need to hear this." That was shocking. Buyer beware is all. We were not being unreasonable. We were a bit loud but it was out of frustration. We did not become unruly, threatening, or belligerent. We did not insult them. We insulted the level of service we were receiving because it was insulting. There wasn't any empathy or understanding. All the manager said was to call the 800# on the receipt. I did and got nowhere.
